Jury Verdict of $380,000.00 against MARTA

Our client, was stopped a red light when a MARTA bus made a left hand turn hitting our clients driver side front. The case was tried before the Superior Court of Fulton County. At trial, two expert accident reconstructionist testified as to how the wreck happened. MARTA’s expert claimed our client was at fault. Our expert refuted everything their expert said. Ultimately, the jury found that MARTA was at fault and awarded $380,000.00 to the Plaintiff

Our client, was stopped a red light when the MARTA bus made a left hand turn hitting our clients driver side front.

Our client, was stopped at a red light when the MARTA bus made a left hand turn and hit our clients driver side front. We claimed that the MARTA bus driver was negligent in making the turn too fast, too sharp of a turn, and was violating almost every MARTA policy and commercial driver guideline, but MARTA denied their driver did anything wrong and instead blamed our client for the wreck.

MARTA hired an expert witness to “prove” that our client was at fault. Their expert created an accident reconstruction animation to show the jury that MARTA could do nothing to prevent the accident. Our expert, who was limited in her testimony by the Court, refuted everything their expert said. She was able to show that MARTA’s expert had used incorrect date. Their expert had used such wrong data that he was incorrect about: the length of the bus, the length of our client’s car, the direction of the intersection, the width of the road, the speed of the bus, the angle of the turn, the positions of the vehicles, and more. The jury was visibly agreeing with everything our witnesses was saying.

Ultimately, the jury found that MARTA was at fault and awarded $380,000.00 to the Plaintiff.

After many months of litigation, we finally went to trial and obtained another victory for our client! The jury awarded $380,000 in damages for pain and suffering as well as medical expenses incurred after being hit by this MARTA bus! Ultimately, the jury found that MARTA was at fault despite what MARTA claimed. The case is now closed and we believe justice has been served for both parties involved in this matter.
